{"id":751,"date":"2024-05-10T09:32:19","date_gmt":"2024-05-10T07:32:19","guid":{"rendered":"https:\/\/adelphe-ip.com\/?p=751"},"modified":"2024-07-19T11:30:41","modified_gmt":"2024-07-19T09:30:41","slug":"patents-wipo-treaty-on-intellectual-property-genetic-resources-and-associated-traditional-knowledge","status":"publish","type":"post","link":"https:\/\/adelphe-ip.com\/en\/patents-wipo-treaty-on-intellectual-property-genetic-resources-and-associated-traditional-knowledge\/","title":{"rendered":"PATENTS \u2013 WIPO TREATY ON INTELLECTUAL PROPERTY, GENETIC RESOURCES AND ASSOCIATED TRADITIONAL KNOWLEDGE"},"content":{"rendered":"<p>After lengthy negotiations that began at the World Intellectual Property Organization (WIPO) in 2001, the organization\u2019s member states approved a new Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge on May 24, 2024.<\/p>\n<p>Article 3 of the treaty seeks to establish a disclosure requirement for applicants with patent applications where:<\/p>\n<ul>\n<li>the inventions are based on genetic resources (disclosure of the country of origin or, in specifically stated cases, disclosure of the source of the genetic resources);<\/li>\n<li>the inventions are based on traditional knowledge associated with genetic resources (disclosure of the Indigenous Peoples or local community who provided the traditional knowledge associated with genetic resources; in specifically stated cases, the source of the traditional knowledge associated with genetic resources).<\/li>\n<\/ul>\n<p>Each contracting party must put in place remedies and sanctions so as to address any failure to provide the aforementioned information.<\/p>\n<p>As a reminder, federal patent law already contains provisions relative to genetic resources and traditional knowledge.
